Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Writing Crucible (“Service”), provided by Writing Crucible LLC (“Company”, “We”, “Us”, or “Our”). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

1. Ownership of Content

You retain full ownership of all content you create. This includes, but is not limited to:

• All text, manuscripts, books, and written works
• Characters, worldbuilding materials, and story elements
• Notes, outlines, and research materials
• Any other creative content you upload or create using the Service

Writing Crucible claims no ownership rights to user-created content. We do not claim, and you do not grant us, any ownership interest in your content. You maintain all rights, title, and interest in and to your content, including all intellectual property rights.

2. License to Operate

By using our Service, you grant Writing Crucible a non-exclusive, limited license solely to host, store, process, and display your content for the purpose of operating the Service. This license:

• Does NOT transfer ownership of your content to us
• Does NOT allow reuse of your content for any purpose other than providing the Service
• Does NOT allow training AI models on your content. We never use your content to train AI models
• DOES allow our servers to function legally and provide you with the Service

This limited license is necessary for us to provide you with cloud storage, synchronization, collaboration features, and other core functionality of the Service. You may revoke this license at any time by deleting your account and content, subject to the data retention provisions outlined in Section 5.

3. Confidentiality & Privacy

Content is private by default. We understand the sensitive nature of creative works and take your privacy seriously:

• All content you create is private by default and accessible only to you
• Access is limited to you and any collaborators you explicitly invite
• We do not sell, publicly disclose, or share your content with third parties except as necessary to operate the Service (e.g., cloud hosting providers) or as required by law
• We do not use your content for marketing, advertising, or promotional purposes

4. AI & Data Usage

Writing Crucible includes optional AI-powered features through our assistant “Cruci”. When you use AI features:

• AI processing: Your content may be processed by third-party AI services to provide features such as writing suggestions, character development, worldbuilding assistance, and social media content generation
• Content storage: Content processed by AI features may be temporarily stored to enable the functionality, but is subject to the same privacy protections as your other content. Such storage is limited to the duration necessary to provide the requested AI functionality.
• Model training: We do not use your content to train AI models. We never use your content for AI training purposes, regardless of how you use the Service
• Optional features: AI features are optional, and you can disable or limit their use at any time

5. Termination & Data

Subscription Cancellation

You may cancel your subscription at any time through your account settings. Upon subscription cancellation:

• Your subscription will remain active until the end of your current billing period
• At the end of your billing period, your account will be moved to the free tier
• All your data and content will be retained and you will continue to have access to your content on the free tier
• You retain all ownership rights to your content

Payments and Refunds

All subscription fees are charged in advance on a recurring basis (monthly or annually) as selected during checkout. We do not provide refunds for subscription fees, including but not limited to:

• Partial refunds for unused portions of a billing period
• Refunds after subscription cancellation
• Refunds for accidental purchases
• Refunds for dissatisfaction with the Service

When you cancel your subscription, you retain access to paid features until the end of your current billing period. After the billing period ends, your account will automatically move to the free tier. No refunds will be issued for the remaining portion of your current billing period.

Nothing in this refund policy limits or excludes any rights you may have under applicable consumer protection laws or regulations that cannot be excluded or limited.

Account Deletion

Account deletion is a separate action from subscription cancellation. If you choose to delete your account:

• Your user account will be immediately removed from active services
• All your content and data will be immediately removed from active systems
• We will retain your data in point-in-time recovery backups for 7 days after account deletion to allow for account recovery
• After 7 days, your content will be permanently deleted from our active systems and scheduled for deletion from backups in accordance with our data retention policies, subject to legal requirements
• We may retain certain metadata as required by law or for legitimate business purposes (e.g., transaction records)

Important: Account deletion is permanent and cannot be undone after the 7-day recovery period. We strongly recommend exporting your content before deleting your account if you wish to retain a copy.

Data Export

You have the right to export your content at any time. The Service provides export functionality that allows you to download your content in various formats. We strongly recommend exporting your content before deleting your account if you wish to retain a copy, as account deletion is permanent after the 7-day recovery period.

Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in illegal activity, or misuse the Service. In such cases, we will provide notice when possible and allow you to export your content before termination, except in cases of serious violations.

6. Limitation of Liability & Warranty Disclaimer

Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Data Loss

While we implement industry-standard backup and security measures, you are responsible for maintaining your own backups of important content. We are not liable for any loss of data, content, or information, including but not limited to:

• Loss due to technical failures, server issues, or system errors
• Loss due to unauthorized access or security breaches
• Loss due to user error, accidental deletion, or account termination
• Loss due to force majeure events or circumstances beyond our reasonable control

Publishing & Commercial Success

Writing Crucible is a tool to assist with your writing process. We make no guarantees, warranties, or representations regarding:

• The commercial success of any works created using the Service
• The quality, marketability, or publishability of your content
• The accuracy or usefulness of AI-generated suggestions or content
• Any outcomes related to publishing, sales, or professional success

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WRITING CRUCIBLE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM GIVING RISE TO SUCH LIABILITY.

7. User Responsibilities

You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Use the Service only for lawful purposes and in accordance with these Terms
• Not upload content that violates any third-party rights, including copyright, trademark, or privacy rights
• Not use the Service to transmit malicious code, spam, or unsolicited communications
• Not attempt to gain unauthorized access to the Service or other users' accounts
• Not use the Service to harass, abuse, or harm others
• Respect intellectual property rights and not infringe upon the rights of others

8. Intellectual Property

The Service itself, including its design, features, functionality, software, and documentation, is owned by Writing Crucible LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or other brand features.

9. Third-Party Services

The Service may integrate with or link to third-party services, including AI providers, cloud storage providers, social media platforms, and payment processors. Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or policies of third-party services.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (sent to the email address associated with your account) or by posting a notice on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and may cancel your account.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Collin County, Texas, and you consent to the personal jurisdiction and venue of such courts.
